Declaration to Revenue -
1.Authorisation to act as agent
I authorise Ireland Tax Aid TAIN: TAIN:81606T Galway, Ireland to act as my agent in dealing with all aspects of the filing of my Irish income tax return, including the submission of refund or credit claims, allowances or reliefs.
Authorisation Form
I authorise for my signature to Authorisation A1/A2 and tax Agent Link Notification Form which Ireland Tax Aid will submit to the Revenue, to access and submit any
authorised claims on my behalf.
I confirm that all documentary evidence of entitlement to credits / reliefs claimed and taxable income sources, will be held for a period of 6 years beginning at the end of the year of assessment to which the Return of Income and / or claim relates by myself.
I confirm that this authorisation will remain in force until Revenue is formally notified of its cessation by either myself or Ireland Tax Aid, or for a maximum period of 4 years. [The submission of an updated Authorisation Form after 4 years will renew the authorisation.]
2. Authorisation for Agent to Receive Refunds on Behalf of Client
I authorise the transfer of any refund or repayment of PAYE / Income Levy / Universal Social Charge due to me by the Revenue Commissioners by electronic funds transfer to the Ireland Tax Aid.
I understand that any refund made by the Revenue Commissioners to my agent, Ireland Tax Aid on my behalf is refunded in a similar manner as if same were being refunded directly to me and that once the refund is transferred into the bank account nominated by me I have no further call upon the Revenue Commissioners in respect of same. I understand that Ireland Tax Aid is acting as my agent and is solely responsible to me in respect of any refund received by them on my behalf.
I further understand that my agent Ireland Tax Aid is an independent entity and that the Revenue Commissioners make no endorsement of my agent or any such agency and cannot accept any responsibility whatsoever for problems encountered by me in dealing with them. I understand and agree that Ireland Tax Aid will input its own bank account details on the Revenue record for the duration of this mandate and will remove these details on the cessation of the mandate.
I confirm that I am aware of, and agree to, the payment of the fees charged by Ireland Tax Aid in respect of the services carried out on my behalf and that this fee will be deducted from any amount refunded by Revenue and that the balance of this amount will be paid to me.
3. Terms and Conditions of Authorisation
I understand that Tax law provides for both civil penalties and criminal sanctions for the failure to make a return, the making of a false return, facilitating the making of a false return, or claiming tax credits, allowances or reliefs which are not due.
I confirm that I will provide the necessary documentation to Ireland Tax Aid to support any refund, credit claims or claims for allowances and reliefs made to Revenue on my behalf by Ireland Tax Aid.
I confirm that I will provide details of all my sources of income to Ireland Tax Aid.
I understand that the person selected in Section 1 above is required to retain all documentation relating to any refund or credit or allowance or relief claimed by the agent on my behalf for a period of 6 years beginning at the end of the year of assessment to which the Return of Income and / or claim relates and Ireland Tax Aid will be required to produce same to Revenue upon request
Terms of Engagement
1. OUR SERVICES
1.1 What we will do:
(a) We will prepare the necessary documentation to apply for tax refund claims and work to secure tax refund on your behalf.
(b) We will generate and submit the required claim forms based on the information provided by you to facilitate processing by Revenue.
(c) Where we determine there is a valid claim for a tax refund, we will submit your application to Revenue. Revenue may also review overpayments of tax and/or conduct a full review of your previous four tax years as part of their process.
1.2 Renewals:
This agreement will remain in place for subsequent tax years unless either you or we notify Revenue in writing to cancel this arrangement.
1.3 Our Commitments:
(a) We will process all verified information provided by you in a timely and professional manner.
(b) We will not audit or verify third-party information you supply; accuracy and completeness are your responsibility.
(c) We reserve the right to cease acting on your behalf if continuing would negatively impact our reputation or compliance with regulatory standards. No fee will be charged for incomplete services in such cases.
1.4 Limitations of Liability for Services:
We are not liable in the following situations:
- If the information provided by you is false, incomplete, or misleading.
- If you have already received a refund or applied for one through another party.
- If Revenue’s records differ from the information you provide.
- If Revenue decides that no refund is due, even when the claim is legitimate based on your submissions.
1.5 Compliance with Service Specifications:
We will provide services as described on our website, subject to updates required by law or regulations. Amendments will not materially impact the quality or nature of services provided.
2. YOUR OBLIGATIONS
2.1 Responsibilities:
(a) Ensure that all information and documentation provided is accurate, complete, and up-to-date.
(b) Cooperate fully with us, including providing all requested documentation promptly.
(c) Disclose any relevant information, including your status as a taxpayer and any debts owed to Revenue.
(d) Acknowledge that you are responsible for any inaccuracies in information submitted to Revenue, and any repayments resulting from incorrect information.
2.2 Acknowledgements:
(a) You authorise us to act upon the information and instructions you provide.
(b) You accept that we may refuse to act on an instruction if:
- It appears unauthorised or unclear.
- It could violate applicable laws or regulations.
- It involves fraudulent or unlawful purposes.
(c) You consent to the use of electronic communications and their equivalence to written agreements under applicable law.
(d) I authorise for my signature to Authorisation Form which Ireland Tax Aid will submit to the Revenue, to access and submit any authorised claims on my behalf.
(e) Based on the authorisation terms below, Iexplicitly give my permission to Ireland Tax Aid to submit any of my PAYE returns (or any of my returns and my spouse’s returns where we are jointly assessed for tax) for the tax years for which Ireland Tax Aid is acting as my agent and I fully understand and agree with the terms and conditions supplied to me.
Rent Tax Rebate
• I confirm I am not related to the landlord.
• I confirm that my Tenancy is registered with the RTB unless the criteria is met where RTB registration is not required.
• I will keep the evidence to support the claim being made for up to 6 years after the claim is submitted.
• To the best of my knowledge and belief, all particulars given are stated correctly.
Health Expenses
• No part of the expenses being claimed were or will be reimbursed from a third party such as any policy of insurance, a public or local authority, or any other source, such as a compensation payment.
• The health care being claimed is carried out, or advised, by a registered practitioner such as a doctor or a dentist.
• I have paid all the expenses being claimed.
• I keep and will keep the evidence (medical receipts and/or MED2 forms) to support the claim being made for up to 6 years after the claim is submitted.
• I have included amounts of qualifying health and dental expenses only.
• To the best of my knowledge and belief, all particulars given are stated correctly.
Remote Working
• I have worked at home either on a full-time or part-time basis.
• I was not reimbursed by my employer for any of the expenses incurred while working from home.
• I have paid all the expenses being claimed.
• I keep and will keep the evidence (utility bills) to support the claim being made for up to 6 years after the claim is submitted.
• To the best of my knowledge and belief, all particulars given are stated correctly.
Tuition Fees
• I have paid for the qualifying tuition fees (third level education course and/or for certain courses in foreign language and information technology) being claimed.
• No part of the tuition fees being claimed were funded by grants, scholarships, or my employer.
• I keep and will keep the evidence (tuition receipts) to support the claim being made for up to 6 years after the claim is submitted.
• To the best of my knowledge and belief, all particulars given are stated correctly.
Other Rebates
• I confirm all information provided for all aspects of my Rebate claim, including the above products and others selected, is true to the best of my knowledge, and I will keep the evidence to support the claim being made for up to 6 years after the claim is submitted.
3. FEES AND TAX REBATE
3.1 No-refund, No-Fee Basis:
(a) If we determine no valid claim exists, or if a claim is unsuccessful, no fee will be charged.
3.2 Fee Structure:
(a) If a refund is authorised by Revenue, our fee is 10% of the total rebate
Example: For a €1,000 refund, the fee is €100
(b) Fees are deducted from the rebate received from Revenue, and the remainder is sent to you via cheque or bank transfer.
(c) If Revenue sends the rebate directly to you, you agree to pay our fee within 7 days.
3.3 Additional Charges:
(a) If bank details are not provided within 12 months, an annual charge of €15 + VAT or one-third of the rebate value, whichever is greater, will apply.
4. LIMITATION OF LIABILITY
(a) Our liability is limited to five times the fee charged for the services provided.
(b) We are not liable for losses due to compliance delays, outages, or Revenue processing issues.
5. COMPLAINTS
We are committed to excellent service. Complaints can be made by email at irelandtaxaid@gmail.com. We will respond promptly and work to resolve issues within a reasonable timeframe.
6. DATA PROTECTION
We handle your data in accordance with the Data Protection Act 2018. You consent to our storing and processing your data as necessary for the services provided.
7. CANCELLATION POLICY
(a) You may cancel within 14 days of signing up without charge, provided services have not been completed.
(b) After 14 days, or if services have been completed, a cancellation fee of €75 or the full service fee will apply.
(c) Cancellation requests must be sent to irelandtaxaid@gmail.com or by post to our registered address.
8. OTHER TERMS
(a) We reserve the right to assign this contract to a third party.
(b) You agree to indemnify us for losses arising from the information you provide or any actions necessary to recover fees owed to us.
(c) We are not responsible for responding to Revenue inquiries post-refund unless instructed otherwise in writing.
